Fern & First (“we”, “us”, “our”) sells custom illustrated baby portraits and related keepsakes. Orders are processed through our checkout provider and fulfilled in partnership with our print and shipping partners.

2. Orders & custom artwork

Each portrait is custom illustrated based on the photo and details you provide. By placing an order you confirm that:

• You own — or have permission to use — any photo you upload.
• The name, date, and other personalization details you submit are accurate.
• You understand the artwork is an artistic illustration, not a literal reproduction of your photo.

We reserve the right to refuse or cancel orders that contain inappropriate content or that we cannot reasonably fulfill.

3. Pricing & payment

All prices are listed in USD unless otherwise noted and may change at any time. Payment is processed securely at checkout. Your order is confirmed once payment has been successfully captured.

4. Intellectual property

All artwork, illustrations, photography, and copy on this site are the property of Fern & First and may not be reproduced or resold without written permission. When you order a custom portrait, you receive a personal-use license to the finished artwork; we retain ownership of the underlying illustration and the right to display it in our portfolio.

5. Disclaimers

The site is provided “as is.” We make no warranties about uninterrupted availability, error-free operation, or that colors on your screen will exactly match printed products. Slight variations in color, framing, and finish are part of the handcrafted nature of each piece.

6. Limitation of liability

To the fullest extent permitted by law, Fern & First is not liable for indirect, incidental, or consequential damages arising from your use of the site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

We may update these Terms from time to time. Continued use of the site after changes are posted means you accept the revised Terms.
